Here at Celebrity Agent, we are always looking for ways to improve email deliverability.
Email deliverability is simply the rate at which emails make it to a subscriber's inbox. In efforts to establish and improve your deliverability, we have implemented a few email policies. You'll want to make sure you read these carefully to help answer any questions you may have.
Celebrity Agent Inc. strictly prohibits any involvement in Unsolicited Commercial E-mail campaigns (UCE, more commonly called "Spam").
1. Contact Consent Verification:
• You must complete this consent form prior to importing any contacts to ensure the validity of the contact list and that you have documented consent for each lead being imported.
2. Zero-Tolerance Policy Against Spam:
• Celebrity Agent, Inc. maintains a Zero-Tolerance policy against Spam, whether direct, indirect, or through any affiliate or agent acting on the Client’s behalf.
3. Proof of Consent:
• As determined by Celebrity Agent, Inc.'s sole discretion, the client shall have proof that all individuals in the client's database have opted in or otherwise agreed to receive communications from the client. The client agrees that all leads being imported into Celebrity Agent Inc. have provided consent, and the client has a record of this consent.
4. Solicited (Opt-In) Lists Only:
• All lists used in conjunction with the services provided by Celebrity Agent, Inc. are required to be 100% solicited (opt-in) lists. This means that the individuals on the list have explicitly agreed to receive information from your business entity. The practice of bartering, purchasing, or renting lists of names and sending e-mails to those people is strictly prohibited.
5. Complaint Rate Compliance:
• The complaint rate ("feedback rate") may not exceed the accepted industry standard at the time of transmission. Failure to comply will result in penalties and restrictions as defined under Violations and Penalties, below.
a. As of this writing, the industry standard for spam complaint rates is less than .1% (1/1000) on a per Email/Internet Service Provider basis. It is the client’s sole responsibility to maintain under the then-current industry standard.
b. Exceeding a complaint rate above this rate will result in temporary restriction of email sending from the Celebrity Agent platform while a deliverability specialist reviews your lists and sending practices.
6. Unsubscribe Requests:
• Written unsubscribe requests must be processed immediately. All unsubscribe requests through Celebrity Agent-provided unsubscribe links are processed immediately.
7. Validation of Imported Lists:
• Initial imported lists will have a sample validated. Any lists exceeding 20% invalid contacts will be temporarily restricted while a deliverability specialist reviews your import and contacts you regarding your list. If deemed necessary, you will be charged for additional contact validation costs.
8. Record Retention:
• The client must maintain verifiable records of consent for all contacts imported into the Celebrity Agent platform for a minimum of 24 months. These records should include the date, time, and method of consent.
9. Compliance with New Regulations:
• The client acknowledges that they are responsible for adhering to all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act, as amended. This includes ensuring contacts have provided explicit consent and that communications are compliant with federal and state laws, as well as any updates to these regulations.
Email Acknowledgement: By signing, I acknowledge and consent to the use of the Celebrity Agent platform to send email messages on my behalf. I also hereby confirm that all contacts have provided their explicit consent to receive such messages, and I understand that I am responsible for compliance with all applicable laws and regulations regarding electronic communications.
